I believe somewhat that you cannot and should not detain somebody on charges that are not honest.  This appears to be based upon the right of the accused to challenge their detainment as a right preserved by law.  It follow from the right to contest detainment that the reason for detainment must be honest?  Is this the right answer?!?!?  Is it really that you cannot detain somebody that is guilty with charges that are not true?  That stands to reason I may believe soon!
EDITOR'S NOTE:
By this, I mean that the guilty cannot have charges that are real charges levied against them unless they actually committed the mentioned crime. 
Indeed, the guilty must be allowed to defend themselves, and who wants to be dicked around by false charges?  Unfair, world governments, unfair!
