Genetic InformationA Story by Winnie MeldaThe act of genetic information nondiscrimination (GINA) of 2008 promise to make genetic discrimination that is illegal in the contexts of health insurance and employment.Study shows that the promises offered by the lay are
difficult to deliver fully to the population. It has been concluded that GINA
is one of the relevant pieces of civil rights legislation although it is not
fully protective of people who are most worried about genetic discrimination in
insurance and employment setting. The law was established so as to offer
individuals with limited legal protection based on the concept of genetic
discrimination. The aim of the policy maker opted to offer protection to family
health information as well as genetic information that could predict future
human diseases, (Kious, 2010). Based on the provisions of the law, Medicare insurer
may get results if a genetic test for payment purposes and should get the
minimal information required. Insurer may not establish rules for adjusting
premiums depending on genetic information and may not request genetic
information before and after enrollment. It is the duty or the work of an
employer to be employed and should not be discriminated with relation
individual’s admission and the employer should not segregate participants in
certain programs, (Kious, 2010). There are potential implications of the provisions
for human resource management of the provisions such as employees’ confidential
issues. The establishment of GINA seems like the end to genetic discrimination
as well as the misuse of genetic information in employment plus in health
insurance setting. Despite the above aspects, the concept may mean a more
subtle use of genetic information by other parties beyond the employment and
health insurance domains. The medical uses of genetic information help an
impetus to enable someone to have genetic testing without fear that the
information will be misused on their genotype information, (Kious, 2010). Reference: Genetic
