Hi again, here’s another short opinion piece written from an unorthodox angle. It’s an enjoyable writing exercise for me.  Remember it’s just an opinion designed to make you think, please don’t take it too  seriously. Hope you enjoy...

 

Modern Law is still on Learner plates.

 

When primitive man first started developing intelligence he gained the ability to do many things differently. One of those things was the ability to deal with inappropriate behavior, protection issues and general unacceptance in a more civilized and organized manner.

But with the unveiling of our brain power came a changing of the guard that this planet had never seen before. For the first time ever physically weaker animals were exercising power over the alpha breed.

Equality is something that has never been applied naturally in the animal kingdom. Our new synthetic pecking order is overriding the working rhythm of millions of years of natural flow. Nature is no longer sorting out the problems of life on earth, we are. So how are we going?

 

Most of us live our lives with law enforcement and the legal system as an afterthought and that’s the way it should be. But upon closer inspection you will find the system is struggling to fully please the masses. Why? The law system would probably identify the following problems for why this is; Changing values, indifferent opinion of right and wrong, a more complicated world, dishonest legal representation & dishonest law enforcement, increasing greed, racism, population density and some other chaotic behaviors which look to be on the rise.

 I’m sure the system would always have expected to negotiate these bumps as it progressed with society, but does the system recognize that IT is responsible for some of these problems flourishing?

Does the law system understand that in changing the fundamental rules of millions of years of evolution they were always going to create many new unforeseen problems?

I believe the system has unknowingly nourished the growth of bullies and provided protective cover for the selfish & greedy to prosper.

I’ll have to explain myself there.

 

I believe the definition of an alpha male may have changed. Once upon a time they were the natural strong person (quite often bigger in size) who was lumped with responsibility. They were most probably the popular choice to lead the hunt, they would have acted as the mediator during disputes and they would have been the head protector of the clan.

These alpha males (and some alpha females) are still being born today and are being forced to constantly suppress what comes naturally.

Modern hierarchy disallows the traditional leaders to execute their natural instincts. These days if you are strong and you act on your instincts you will end up in trouble with the law.

The thoughtful decision making of the clan leader has been replaced with blanket rules. Sympathy is artificial and the rules are constructed from the recommendation of those who feel the need to speak up.

In primitive times bullies were nasty because they were jealous, similar to how thay are today. But back then bullies probably just needed a bit of physicality to pull them into line, animal kingdom style.

 These days bullies are protected and they know this. From behind a shield they are free to grow more jealous and more horrible until they become out-of-control monsters.

In primitive times probably around half of all young males were potential bullies but hardly any would have stayed that way into adulthood. These days plenty roam our streets.

Protecting a bully’s “rights” has provided them with the cover they need for their anti-social attitudes to prosper.

Society is also to blame, rewarding the educated and punishing the "less intelligent".

 

Other problems?

 

Plea bargaining. What a joke this is, half of the statements read out in a courtroom are made up stories agreed to and then pleaded guilty to. The real story is irrelevant and nearly always completely different to the one the court hears. Do Magistrates and Judges know they are being lied to every five minutes?

 

Patenting. The most greed supporting law on the planet. The ability to stop progress and save lives is in the hands of many who just want to make more money than the people who surround them. I agree that some patents are fair but many are not.

 

Revenue raising. I know our economy needs the money but do they have to raise it in such a blatantly unfair way sometimes? It breeds hatred.

 

Do I think we should unwind our laws, of course not. But I wouldn’t mind seeing the reasoning behind many rules being looked at and debated. I think it would be a healthy step towards our law system getting it's P’s.
